As there've been no updates to the contrary (that I'm aware of anyway), you'd go by the latest technical funding guidance;
31. The qualifying period for apprenticeships is 42 days; it is only lower for apprenticeships when a break in learning occurs. If the apprentice takes a break in learning and then returns to learning, we will apply the qualifying period to the new programme aim before any monthly installments are calculated. This also applies when the apprentice restarts for any other reason.
32. As an example, if an apprentice restarts an apprenticeship after a break in learning and the remaining planned period of the apprenticeship is 2 months, then the new qualifying period is 14 days.

So from your point of view, if they did not meet the qualifying period following return would you extend the original BIL or would you return them based on dates in learning and just appreciate funding won't be drawn down for that period? I think the latter personally
Definitely agree with your assumption, and with Steve. To add to Steve's rationale, returning them before processing the second break would also ensure you're in-keeping with principle 1 of the 'Data management principles for ILR completion' which states;
Principle 1: The ILR must accurately describe the provision delivered to each learner
The data you record on the ILR must accurately reflect the journey for the learner and what has happened. Inaccurate information must never be entered even where it is perceived that this would result in a more equitable claim for funding or accurate record of performance.

If a learner returns from a break in learning is the qualifying period for funding still as per the funding rates guide so it would depend on the length of the return learning aim?
If less than 167 planned return date then it would only be 14 days?
I am getting questions about the new BIL rules for active learning and we may have learners come back from a BIL but then need to go back on a BIL, however if they have not met the qualifying period then do we just extend the original BIL?
Learners will have done some learning and OTJ so don't want to loose this so ideally would bring them back and then return them with the understanding that we will not have drawn down funding for this period.
