Learner on paternity leave

Hi,
We have a learner on paternity leave for 2 weeks, does anyone know whether due to this - is there any le-way on the 4 week active learning rule or does our learner need to get something done in the next 2 weeks after his paternity leave or face a BIL if he hits 4 weeks no active of which 2 weeks are paternity leave?

I would not include the paternity leave period as with holidays the following applies.
P265.1 A break in learning must not be recorded:
P265.1.1 For annual leave, public holidays and short-term absence (up to 4 weeks).
