Hi,

Should the contract for services / service level agreement between the employer and provider be signed and dated on or before the apprentice's start date?  The funding rules aren't clear.

It should ideally be signed before the start date to save you the aggro because it's contents will need to have been agreed in some form or another before the start date, but as you've rightly pointed out it's not explicitly stated in the funding rules.

P344 explains that the evidence pack should contain the contract for services, and what it needs to set out, but the majority of this will in all likelihood have already been 'signed off' via the Commitment Statement/Training Plan and Apprenticeship Agreement. You could also look into employing an 'effective date' or 'commencement date' in your contracts which could, providing they're formally set out and explained within the terms and conditions, serve to apply the particulars as of a date prior to the signatures; though that's something for you as a business to determine. 

Safest bet is to get it signed on/before the start.
