Could we leave them at 'Gateway' until they eventually pass?
Seems highly unlikely that they would pass, no? Solely on the basis that, as you've said, the job role doesn't fully cover all of what's required to pass the EPA. In addition to which you'll need to consider the cost implications of endless resits. If you think it's a possibility, and the costs aren't prohibitive, then go for it.

This seems the most likely outcome. The apprentice has done enough to reach gateway, and has completed an EPA, albeit unsuccessfully. This would meet the requirements for it to be marked as completed/failed. I suspect a difficult conversation may need to be had with the apprentice, and whoever decided that 'blagging' would work.

We have what I can only describe as a weird (and shouldn't have happened situation.)
An apprentice went through Gateway and attempted EPA twice and failed. It's since come to light that their job role does not fully cover all of what is required to pass EPA and someone thought they could just 'Blagg it.'
What would the advice be in terms of leaving them on the ILR?
Could we leave them at 'Gateway' until they eventually pass? If we put them back to 'in learning' there won't be any further learning to complete so we would face a situation if audited.
Or we could just record them as completed, no achievement but the apprentice would be disappointed with this result.
Any suggestions would be apricated.
