Clarity on asylum funding rules

Good morning, I would just like some clarity on a funding rule. We have an employee who would like to complete a L4 retail apprenticeship with us as an employer-provider. For the last 5 years, he's been in the process of an asylum application at the home office, this has meant our HR department has had to do Right to Work checks with the Home Office every 6 months for his employment to continue while his asylum application is still on-going.
I can see from the rule page 107, EP366.1. as he has lived in the UK for more than 6 months and no decision has been made he will be eligible for the apprenticeship funding but I would like clarity on the following due to the rule page 107 EP367.1
*While he's completing his apprenticeship, if his asylum application is refused and he appeals with the home office, will he have to go on a break in learning for 6 months before he is eligible to continue with the apprenticeship providing no decision has been made on his appeal?
