I think that OR is misleading. If they've already got a full level 3 or above, they aren't eligible for this funding on the grounds of prior attainment. I think it's talking about the handful of quals available under this offer, that aren't a full level 3. If they have one of those, they're also not eligible, even though they don't have a full level 3? You may still be able to fully fund if unemployed and on benefits, or on a low wage.
Thank you for your response Ruth Canham-James. In line with the other 'general' eligibility guidance for this offer I think we have misinterpreted the statement highlighted as you describe. The learner is employed and earning above the low wage threshold so wouldn't be fundable.

Good afternoon,
We have a potential learner who we believe is eligible for the above based on the funding rules however when returning them in R02 we are getting an error (R182). It may be that we are misinterpreting the below but I would appreciate others thoughts please. The learner is 19+ but has a prior attainment record with a Level 4 qualification listed. From the rules below we believe that this learner is eligible based on the emboldened text?
We will fully fund individuals as part of this offer where they:
are aged 19 or above on 31 August within the 2022 to 2023 funding year
have not achieved a full level 3 qualification, or above, which meets the requirements set out in the full level 3 section; or
have not achieved a qualification available through the level 3 adult offer, unless that qualification is a short qualification, as set out below
enrol on the level 3 adult offer qualifications approved for funding with effect from 1 April 2021
