I don't know the answer, but I'm really interested to see if someone else knows. I thought the SEM flag was small employer waiver eligibility, but that's not what the ILR spec says, it's just whether the employer is small or not. The rules don't say it's non-levy only either. The likelihood of an organisation with fewer than 50 employees being a levy payer is fairly slim though. The mean average salary would have to be over £60k. If I thought we had an employer in that scenario, I'd just see what happened in the monthly funding reports, and invoice the 5% if they didn't get 100% funded to their insufficient funds.

Hi,
Just checking my R14 data. If a levy paying employer has stated they have under 50 employees, do we need to record them as an SEM? Or is it just relevant for non-levy paying organisations?
If it's the first option, if the levy pot runs out would a small employer with a relevant learner e.g. 16-18 need to pay co-investment?
