The apprentice must remain employed under an apprenticeship agreement until the EPA is completed.
P160 The apprentice must be employed until the end-point assessment is completed. Consideration must be given to the potential time needed for any re-sit and / or re-training prior to re-taking the end-point assessment so the apprentice remains employed during this time.
Like Martin says, they can't resit. It's a real shame, and we get a few like this. We try and make sure any fixed term contracts for apprentices have plenty of time to cover resits, but sometimes the apprentice chooses to get a new job knowing their contract is coming to an end, not remembering that they can't do their EPA unless the new employer signs up with us to do the EPA.
You always have to have evidence for redundancy, like a letter to the apprentice, or evidence that the business folded. End of contract doesn't count.
Even if they were redundant and you were therefore allowed to do the EPA without an employer, there's nobody to pay the resit fee. ESFA will pay the original Assessment costs, but not any more.

Good evening all,
I have looked through the rules but cannot see (or am missing it) if it states anywhere anything regarding this:
We had a learner, on 31 August at the end of his apprenticeship contract. Unfortunately learner has since failed his End Point Assessment and will require further training in order to prepare for a resit.
2 queries here:
1) Would learner qualify as redundant – my thought is no;
2) As he is currently unemployed who would fund the resit fee?
