Returned from a break in learning tupe to new employer

I think I might have tied myself in knots with this one. We have a situation where a learner has returned from a break in learning , while on the break in learning her employment has gone through TUPE she is now with a new employer. We are also the training provider for the new employer and the new employer is eager for her to complete the apprenticeship.
I have in my notes that any change of employment during a break in learning leads to a withdrawal, but the learner can come back to study the same aim as a restarted learner.
Reading the rules this morning however I disagree as there wasn't a period of unemployment that lasts more then 12 weeks.
Did I imagine that a change of employer automatically leads to a withdrawal while on a break in learning?
