We are thinking of asking are you ordinarily resident in the UK question at each enrolment just in case things have changed since their last enrolment (even if very unlikely). In addition to this we are going to ask to see evidence of British citizenship once at start of relationship with the learner. If not british citizen then we are going to ask to see e-Visa, ARC or Armed forces evidence. This will be checked each year unless the e-Visa or ARC has an expiry date which does not cover the full funding year then we will re-check at next enrolment. Would be good to hear how others are interpreting and planning on implementing this change of guidance. *Why on earth does the DfE not just specify in the guidance what needs to be done - I didn't think the residency section could get any worse but the DfE have outdone themselves this year - sorry rant over :-)

There was a similar query on another post where the learner had partner visa but told them their husband was here on a sponsorship visa. If the learner has an e-Visa showing partner, spouse or dependant, are we saying that we need to ask to see the partner/spouse e-Visa as well??

This is worrying, if we saw an e-Visa for someone and the status showed as 'Partner' we would consider them eligible. You only knew the husband was here on a sponsorship visa because the learner told you, if the learner doesn't say anything then surely we can only take what is shown on the e-Visa.

Ceri Fishlock we have taken the guidance to mean that if the e-Visa or ARC (for Asylum seekers) shows an end date then this needs to be on or after the course end date for the learner to be eligible to enrol unless they can provide separate proof that they have submitted an application to extend their visa. As Steve Hewitt has mentioned, most e-Visas don't show an end date, if there is no end date we assume their permission will cover their whole course and they are eligible.

I logged a case with the DfE to ask whether they expect providers to view and record details of e-Visas for all learners who are not british citizens and if we can use self-declarations from learners to confirm if they are here legally and will be permanently resident in the UK at the start of their course. Their reply was: For Audit purposes we would be happy with seeing a note made by the provider of what they have seen, when and by whom and this is signed and dated as proof of why the decision was made to fully fund the learner. We would not consider self-certification to be acceptable evidence.

Goodness Tara Cutress I didn't consider that difference. I think most learners with leave to enter/remain would answer Yes they have a permanent address in UK.

Daniel Dowson I agree, I never find the DfE guidance helpful, its very poorly written. If I released this to my users as it is, we would be drowning in questions :-). I am thinking of 2 self-dec questions, one for the ordinarily resident at start and one for their immigration status otherwise how do we identify asylum seekers, those on a student visa or those not legally in UK...? Who does the learners with limited length visas section refer to? Asylum seekers only?

We are getting these errors this month too. I've just been reading through some previous posts and others are suggesting that we need to use LDM 391 for those unemployed with JSA, ESA, UC as well as for earnings under threshold and unemployed/not receiving benefits/looking for work. The BSI value alone for the benefit is not resolving the error.
