Yes I would expect that the agreed price at the start should be treated as binding (and would be specified in the contract between training provider and EPAO). Having said that, if the EPAO decided to cancel the contract because they knew they couldn't deliver at the agreed price, you're still left with the same problem. Fundamentally this is a problem caused by the fiction that the Training Provider is subcontracting the EPAO for their services (and passing on ESFA money to them) when logically the EPAO is providing a service to ESFA and should be contracting/ being paid direct. It would make everyone's life easier if the funding bands were calculated for the training element only.

The variation may not be fully explainable using the Funding Summary Report and Monthly Payment Report - I had an unexplained difference which the HelpDesk clarified was an FRM27 (previous year) recovery. The Funding Summary Report has a line for clawbacks but those are (I think) only in-year.

In your ESFA agreement (contract) there are two relevant paragraphs: 12.3 High Needs Apprentices (those with a funded EHC plan) - DSB for relevant staff, 12.4 Criminal records checks for all Training Provider staff from overseas with access to apprentice data, and 12.6 checks and record-keeping in respect of health, safety and safeguarding. In general organisations are discouraged by DSB from being over-broad in checking for staff who do not have regular unsupervised contact with children and vulnerable adults, so your safeguarding policy should identify which roles need DSB checks.
