Got it. Which makes me wonder why do the rules say, if they have them they will be eligible?! Or am I missing something else that a Tier 4 holder may have that would make them eligible?

BUT...Am I correct in thinking that if they met any of these below, then they would be exempt from the Residency and also be eligible? 43.1. refugee status 43.2. discretionary leave to enter or remain 43.3. exceptional leave to enter or remain 43.4. indefinite leave to enter or remain 43.5. humanitarian protection 43.6. leave outside the rules16 43.7. the husband, wife, civil partner or child of any of the above in paragraphs 43.1 to 43.61 43.8. section 67 of the Immigration Act 2016 leave 43.9. Am I right in thinking that a standard 'leave to enter' permit would NOT make them eligible, it needs to be discretionary etc etc as per the 'list'? Can I just clarify however.... if someone has a 'leave to enter' with a type of permit 'PBS dependent' does that make them eligible for ESFA funding?

You were kind enough to provide me with the alternative report logic used by the DSATs, but would you have a formula I can add into the DSAT to enable me to identify the planned hours that their own logic arrives at, as their alternative minimum please?

Gary - I agree that it is open to interpretation so would be very interested in hearing the response from the helpdesk, please - it would be very much appreciated by all I'm sure, not least by Ruth OR Martin who can then revel in their correct interpretation :) (I have a fiver on Martin, soz Ruth:))
