FYI - FIS is throwing out an "DateOfBirth_48" / "The learner is not over the school leaving age" error so i'm guessing its a no! :)

Thanks Ruth Canham-James. I assume had the learner completed first episode in learning and withdrew in the same month then they should never reach the ILR in the first place so this wouldn't be an issue. Just happens it was near month end in this instance :) Thanks

Steve is right, consider separating out the question into Compliance and Quality Compliance = no funding or audit requirement to evidence initial assessment for learners who present exemption evidence. Quality = 1) how do you know the learner has the requisite level of E/M to meet the required level of the Apprenticeship; 2) what would be your teaching & learning response to a learner who has exemptions but achieved =<L1 in their I/A (consider learners who have exemption evidence from many years ago, how do you know their level of E/M hasn't lapsed?); 3) does your Apprenticeship have an entry criteria (ie L4+ Apprenticeship = minimum L2 standard in E/M - is this based on exemption evidence of I/A results? No right or wrong answer to this, but consider that the higher the apprenticeship level, the greater potential it has to be more academic/stretching in nature and therefore may require a requisite level of Functional Skill - if that's the case how will you assess this without doing an I/A? On whole the majority of the Providers I know do an I/A irrespective of prior attainment and decide on the best route forward from there on a individual learner basis (and of course Steve Hewitt hit the nail on the head....consider our friends at Ofsted !!)

Emma - I can tell you from first hand knowledge (having been audited by ESFA only last week) that your proposed approach would be acceptable and in fact expected (i.e. learner keeps OtJ Log up to date regularly, is reviewed by their Coach/Assessor/Trainer (whatever your staff are referred to), signed by the learner and approved by the Line Manager) Important thing to remember is that the OtJ entries themselves are very clearly linked to both the KSBs of the Standard AND the learner's planned OtJ contained within the learners Commitment Statement (ie if you have listed out modules/units for example) Also ensure that the entries themselves are very clearly OFF the job learning and not ON the job - this is something they are very hot on! As Sue states, many SaaS Apprenticeship systems (OneFile, Aptem, BUD etc) have this functionality now built to minimise risk and support your operating processes Hope this helps

True....but in this case the learner had first day in learning, was reported in the ILR but disengaged shortly after so was put back to start as effectively the first day in learning was also their last. Do they need a new ILR record or do we update the existing one?
