Ibrahim, this goes against the Multiply guidance on interventions though doesn't it as we were told by DfE that any interventions which are 2 hours or more have to go on the ILR, so in essence you could have a half day course, ie 3/4 hours and we would anticipate putting this on the ILR as starting and finishing on the same day but what Michael from ESFA is saying wouldn't allow for that would it :(

Hi, was SteveH's query ever answered please regarding sub-contractors? I don't think 6.6 is explicit enough about subcontractors, I'd quite like a line that *says* subbies are not to be included. We are well on our way with our data return for our own staff, would hate to be told at this late stage that we somehow have to collect the data for our sub-contractors for AEB too?

Hi there, just if it helps, we explore the circumstances as to why they don't have an NI number, if they intend to work or claim benefits they should have one or intend getting one, and the ILR spec does say anyone claiming benefits should have NINO provided via ILR, so as long as you're comfortable they aren't on benefits you should be able to put them through. It tends to only be Asylum Seekers we find who may not have them 'yet' or the odd older person who is maybe retired and not claiming benefits or intending to work but as Steve said it's not mandatory but very much encouraged. We get probably about 97% of NINOs but have to allow for the odd one that doesn't have one for valid reasons.

Joan Mitchell - we had someone like this and we made a decision here that we couldn't fund them for ESOL as they should be up to an acceptable level from the terms of their visa. They joined one of our ESOL classes but paid I think. Like I say that was just one person and we made that decision, I'm not saying it's the rules by any means.

I just got a reply from ESFA this week, this is what they've said which doesn't solve the issue obviously but......: Dear Angela Thank you for your enquiry. We are currently liaising with colleagues in the Home Office to understand some issues providers are having with the updated e-Visa system and will provide an update shortly. In the meantime, we would ask that you request additional paperwork to confirm status and length of residence from any learners whose e-Visa does not provide the necessary information. We would expect in most cases the learner would have correspondence from the Home Office from when their status was issued which should provide more detail than the e-Visa. Where learners need to confirm 3 years residence we would expect they may be able to provide evidence such as utility bills which show them resident in the UK for 3 years.

Thanks Steve, so it's a check of the expired BRP in a sense for all that 'other' information we need around status etc and then an online check to confirm the valid to date is acceptable on the new system. Great.....not. But I get what you're saying it wasn't designed for us/ESFA/MCAs etc, we just 'use' the system. I might flag it to ESFA just to see what they say and how they suggest we work on this but thanks for replying as usual, Angela
