Ben James - thank you! That does make sense actually - I think I was just concerned about the actual end date needing to be the end of learning, although from the rules perspective it doesn't make logical sense!! I've learnt something there though!

Ben James Should it be continuing in 20/21 if they have finished all learning (relating to after Aug 2019 starts anyway)? In the ILR spec it says: For apprenticeship standards on a programme aim, where the learner has completed all learning activities and begun the End point assessment period prior to 1st August 2019, the Learning Actual End date in the 19/20 ILR will continue to include the end point assessment (as per the 18/19 ILR specification). For apprenticeship standards on a programme aim, where the learner has not completed all learning activities by 1st August 2019, the Learning Actual End Date will be completed after all learning has taken place and does NOT include the end point assessment period. Planned end date is the training period (Aug 2019 and after) so it doesn't make sense it would include the EPA, only if before Aug 2019.

If the plan is that all the learning would be completed on the component aim and this then coincides with all the learning being completed to meet the standard (programme aim) at the same time then they would have the same PED.

They have to have been in the UK for 3 years for any of the non UK-national criteria. Unless they have an eligible family member or 3 year exemption status, they wouldn't be eligible.

Thank you both, that's really helpful. I actually interpreted the funding rules incorrectly (or didn't read properly) the section other non-UK nationals, they only have to meet one of the criteria, so this scenario can be under non-UK national, which makes much more sense!

That makes much more sense when comparing it to paragraph 219, which I was extremely confused about in relation to 218! You can use this amount of non-formula community learning funding (stated in your Appendix 1) to deliver non-regulated provision that may be similar to community learning, and/or regulated qualifications to meet local demand. If you do, you must: 219.1. follow the ESFA funded AEB formula-funded methodology and submit ILR data under funding model 35 219.2. enrol learners following ESFA funded AEB eligibility requirements set out on page 36 and paragraphs 151 to 215, you must not use your nonformula community learning local fee remission policy Thank you for your help, makes much more sense! My interpretation was that providers had to set the way they would use their CL allocation as if it was AEB (using the AEB methodology), instead of being able to set their own 'funding rates' based off other criteria for their CL grant, so I guess the latter is correct?

Thank you everyone for your advice! I've followed it up with the Apprenticeship Service too and they recommended to go through and record the BIL. Sarah Lane I'll double check and make sure that our learner will finish before the end of the funding year with the break, just in case we end up in the same situation! Thank you!
