During an ESFA audit we were asked to collect evidence from the employer of payment - if not available then they have to pay again. If they have proof then I believe the ESFA can supply an LDM code to overwrite the ILR. If this isn't done then it may effect your completion payment and/or failure of EPA.

That is good then. Luckily in our case the employer admitted the charge but also admitted they had failed to understand the rules behind Apprenticeships. Good to see it wasn't the worst case scenario for your learner.

Hi, I was involved in a recent ESFA Audit where we had found one of our Subcontractors learners had been charged. The auditor asked me as the 'Prime' to contact the employer and request they refund the learner - which they did but I could see how there is some employers who wouldn't.

This error should go on your next upload after the start date - you will just have to remember to create a new file and load it up. If you are error checking I would ignore on this time but after the 24th it shouldn't be there.

Melanie Aspinall - thank you, that's what I thought to. Seemed a little strange. Thought I would check, ITPs seem to have the same rules but different at the same time. I will get my head around them soon I am sure.

Hi Thank you for that - I think from your POV that is correct. We are using our own Levy funds (so we are the provider) delivering to our own staff. Can't seem to find clarity in the funding guidance (but that doesn't surprise me) - thank you though I appreciate your reply. J

Good Morning Stacey, I have come across some guidance which says that for 'apprentices at all levels (apprenticeships) with formally recognised special educational needs, learning difficulties or disabilities, who struggle to achieve the regular English and / or maths minimum requirement due to the nature of their difficulty or disability, we will accept achievement of entry level 3 functional skills in English and / or maths. You must make every effort to enable apprentices with special educational needs, learning difficulties or disabilities to achieve the minimum English and maths requirements of the specific apprenticeship. This includes appropriate use of access arrangements, reasonable adjustments and other approved qualifications that are detailed in the ESFA list of qualifications approved for funding.' There is also a Temporary Suspension in place for anyone from 1st August that is due to take their End Point Assessment before the 31st December where the L2 requirement is not needed. So if your employee can get a L1 Maths completed with his Statement he would be able to complete. (By the rule above he maybe able to do a E3). You would need to clarify this in the Funding Rules with the provider but that is my understanding. Hope it helps.
