You only get a datalock 09 if the start date in the ILR is before the start date on the apprenticeship service funding record, so in theory you could use the existing funding record.

This might sound really obvious, but you need to ask the employer to look at the record on the service and approve the change. I've had this recently where the employer hadn't received any notifications from the service that a change was pending. Additionally the change request seemed to expire after a couple of days - possibly a following data return cleared it?

Yes, you need to evidence learning on the restart date. It can be any eligible learning activity that counts towards their OTJ training plan (or English/maths as per the funding rules). In terms of being out of sync, you'd need to decide internally how you want to deal with this and then update the training plan. There's no guidance in the funding rules other than that you should replan delivery and extend the duration accordingly.

We recently had a similar situation recently where an apprentice sat EPA in December and then immediately left the company, and the employer put a stop on the record in December. I was under the impression that we would need to get the employer to move the stop into January, but they never did this. When the outcome was recorded a couple of months later we still received the completion payment and the record status on DAS has changed from stopped to completed.
