I submitted this same query to the helpdesk this week and the response was the below so it's a no to dependents of Skilled worker/Sponsorship visa's being eligible. Learners on skilled worker sponsorship visas are not eligible for ASF funding, as these visas cannot be extended, individuals on such visas can only remain in the UK for a limited period (typically 2 to 3 years), which means the skills acquired are unlikely to be utilised within the UK labour market. This includes their dependants

Thanks for the update Alison - we'll wait for the updated funding rules to be published. Good that they've done a U-turn but means we'll have to check the e-Visas of partners/dependents still to check they're not a seasonal worker.

Hi, we have been speaking to college's who we work with and are in agreement that we will need to request the partner/spouse e-Visa to confirm it is not one of the Sponsorship/Student/Graduate visa's. It's frustrating and ideally, the e-Visa would state the Partners e-Visa status to avoid requesting further e-Visa's and evidence.

We're a distance learning provider and all learners apply online so in some cases, they declare on the application they are receipt of low wage but don't always attach the evidence. Most do send it in for the month before but in some cases we might have a learner who provides the payslip for the month after they enrolled - we would then work it back to the tax month and gross pay YTD to establish they were eligible at the start of the course. As the rules state "within 3 months" we've never had any issue with our audits on direct or sub-contract provision before now.
