Thank you Ruth Canham-James this is what I originally thought and had someone question it, so I doubted myself.
Cassandra Adams I spend a lot of my job doubting myself and looking things up because someone is trying to persuade me they can get away with something! It's always useful to get a second opinion.
Sorry to reopen, but this is query that we've been talking about at the moment. If a learner is on a part time contract but then switches to full time part way through the Apprenticeship. What happens here with the minimum length of stay and OTJ? We can't change the planned end date can we?

Early Completion for Part time Learners

Looking for some clarity on Part time learner duration and early completion, as I've seen different views.
We a have learner who is ready to go into EPA but has completed all learning slightly earlier the expected planned end date. We had extended the programme minimum duration due to the part time hours using the below from funding rules.
P36 If, at the beginning of the programme, the apprentice works fewer than 30 hours a week you must extend the expected duration of the apprenticeship on the ILR (pro rata) to take account of this. You must work with the employer to make sure that the dates on the apprenticeship agreement and training plan are also extended. P36.1 Where a part-time working pattern is applicable, you must agree with the employer and the apprentice the extended apprenticeship duration. You must extend the minimum duration using one of the following formulas:
P36.1.1 12 x 30 / average weekly hours = new minimum duration in months; or
P36.1.2 52 x 30 / average weekly hours = new minimum duration in weeks
Does this mean that the extended duration has to be met as this is the new minimum?
Or
Can any learner complete early regardless of hours worked, as long as they have met planned OTJ and its over the 12 month minimum?
