I'm not actually sure what happens if they do have a new employer who won't support as it seems to largely cover those who can't find a new employer, it seems wrong to penalise the learner because of an employers unwillingness.
It would be absurd if a student who didn't find a new employer could continue, but one who found a new employer who wouldn't get involved, couldn't, it's essentially the same thing. I choose to interpret this as anyone who is made redundant with less than 25% to go, can continue (assuming it's practically possible), regardless of subsequent employment status. If that happens though, I wouldn't be comfortable with the new employer being involved in any way, other than perhaps releasing the apprentice for time to do some OTJ. They shouldn't be involved with the EPA. If the apprentice can't do the EPA without a workplace assessment, I'm not sure what I'd do.
We seem to deal in absurdity on the regular, I agree it would be punishingly unfair on the learner. I suppose there is nothing stopping you keeping the new employers records away from the ILR and have them sit outside the EPA process. Would be good to get the official stance on this or hear form someone who has reported an occurrence in this way.
Practically speaking, how would anyone know the apprentice had a new employer if you don't record it in the ILR, and no further OTJ or anything else is linked to an employer. You tell the EPAO the apprentice has no employer and you work with them on how to complete the EPA.
Has anyone got any experience with a fully unemployed apprentice completing EPA that requires a workplace assessment? We could do some in our own salons for hair I guess, or perhaps another friendly employer we work with could offer to let an apprentice do an assessment with them.

If an apprentice has completed more than 75% of their practical period, has been made redundant but then finds a new employer who will not support the apprentice in terms of funding (they will support with the EP and OTJ). Are they able to continue their apprenticeship funded by the ESFA? Would we just record them as a withdrawal due to redunancy?
