Good afternoon all, 

Following the commencement of the new academic year and finalisation of hard close (R14), we have seen a caseload of learners that have gone on BIL, yet last date of learning took place in the previous academic year (June/July 2022). 

Are we able to complete this BIL and back date to June/July? I don't want there to be any repercussions of actions taken, however also want to ensure if action is taken, that reporting is completed correctly as I believe an EAS is required.

Yes, you absolutely need to use the actual last date in learning, despite the fact it will unfortunately mean you get some FRM27s appearing.

You should always reflect reality as far as you are able. Yes, you can and should back date the BIL to June/July in your 22/23 ILR. Be aware though, that it means you overclaimed funding in June/July (assuming they weren't yet past their planned end date), and that will appear in the FRM27 report. That should trigger a claw back at the end of 22/23. We had some this year. These are the report notes;

You can't hand that money back via the EAS as far as I'm aware, they contact you.

Sorry Ruth, that time of day haha! I will second your final sentiment though... you don't pay it back via EAS. They should contact you!

From our FRM27 for 21/22, we got contacted about claw back for one funding stream, but not another. Very odd! Maybe they only bother where the value is over a certain threshold? 

Every time this happens, I do give the teams a grilling about why a student hasn't attended/done any OTJ for over ten weeks, and they hadn't done anything about it. A couple of weeks before R14, I now remind teams to triple check they've got attendance evidence in the new academic year, before we close the old year.
