Many thanks both.  I have added the required aims as Martin advised (the service desk also confirmed this is what we should do) and run an xml export file from our MI system through FIS and Submit Learner Data successfully without error. We have also checked the original programme planned end date remains the same in the xml export file (which it does) so hopefully we won’t be presented with any problems with regards to the above further down the line.  Thank you both for your help. Many thanks Martin...do we still use the original programme planned end date for the new aim even though the start date would be after or do we use a new planned end date just for that aim.  We've never encountered this situation before so I'm a little unsure as to what we're doing. Emma

Many thanks both...I'm just a little confused as even the provider support manual doesn't suggest they have to pass (re below): Recording apprenticeship standard completions For apprenticeship standards that complete their learning on or after 1 August 2019, when all of the training and end point assessment elements have been completed, the following should be recorded: All the component learning aims within the programme must be closed with the Learning actual end date set to the date of the last learning activity for the aim(s). The programme aim must be closed with the Learning actual end date recorded as the date the training period for the programme was finished, not including the end point assessment period. The programme aim must be updated with the Achievement date recorded as the date the end point assessment period for the programme was completed, whether the outcome was a success or a failure. The Date applies to must be recorded on the latest Apprenticeship contract type FAM record as the same date as the achievement date for the programme aim. When the end point assessment period for the apprenticeship standard is complete, the Outcome field must be updated accordingly.  If the apprenticeship standard has resulted in a failure at the end point assessment, the Outcome on the programme aim must be recorded as code 3 ‘No achievement’.  If the apprenticeship standard is successfully achieved following the end point assessment, the Outcome on the programme aim must be recorded as code 1 ‘Achieved’. In order to be recorded as ‘Completed’ (Completion status code 2), both the training and end point assessment activities for the programme must be completed.  An end point assessment that has resulted in a failed outcome can be classed as complete as long as the learner reaches the end of the end point assessment period, rather than withdrawing.  If either of these have not been completed, then the programme aim cannot be recorded with Completion status code 2. Hi Gaynor, After much toing and froing between the Apprenticeship Service and the Funding Rules Policy Team the Apprenticeship Service did stand by their original advice (that we should have withdrawn and restarted the apprentice), however as the DLOCK_10 error was not effecting payments and we continued to receive the correct funding for this learner in relation to both employers they then advised that we leave the data in our ILR as it was (a straight forward change of employer).  We never really did get to the bottom of the problem as to why the DLOCK error was present…I still suspect it was an anomaly on the data match report but could be wrong.  With regards to achievement rates, unfortunately this learner decided to leave our training programme early and didn’t achieve anyway, so for us had a negative impact regardless.  Sorry I can’t be of any further help, this one did take the Apprenticeship Service a good while to try and resolve, our query was raised in February and wasn’t closed off until July. Morning Ben / Martin, Thank you for your replies, we are going to have to withdraw this learner unfortunately as they have not been able to secure further employment at this time due to the nature of their break.  We are not even sure at this stage when they plan to return to the training programme. I did email Apprenticeship Service Support prior to posting here for confirmation on the correct process to follow but they have so far failed to get back to me. Emma

Hi Simon / Melanie, I was also on the ESFA funding rules webinar yesterday and asked the same question, they did suggest that this is something they may look into and may incorporate an update in V1 of the rules (to be release at the end of the month).  Hopefully we’ll receive some further clarification then. Hi Melanie, We are just in the process of going through the clarification version of the 21-22 funding rules but so far have been unable to find a template / example of a new Subsidy Control Declaration Form for the waiving of Employer Co-Investment (on the gov.uk website or elsewhere).  Is this something the ESFA normally produce as we don’t recall ever being provided with one for state aid either, we just used our own, taking guidance from other sources. If anybody could please advise if there is a standard template or an example of this form available for providers to use we would be extremely grateful. Many thanks Emma

Many thanks both. We were aware of this new validation rule added in V7 of the ILR validation rules document, however do seem to have misinterpreted what the 20-21 and 21-22 ILR specification says as it does make it sound like it only applies to standards (referring to the practical period, gateway and end point assessment etc.)  they should really re-word these paragraphs as to not cause confusion. We have indeed been recording the planned off-the-job hours for these learners just need to go back in and record the actual off-the-job hours.
