Hi Guys Just a quick follow-up question I am being asked. If employed prior to starting their evidenced learning with us (the provider), except for the the sign-up documents etc, do we need to collect any other form of evidence from the employer between these two dates? I understand that payments will not start until they start their practical period as this is the start date on the ILR, but I am being told that they possibly could start some legit training towards their apprenticeship with their employer before starting official learning with us. I know what my answer is, but would like to hear what others think! Thank you

Thank you Martin. I agree. I would only expect as a maximum, within one week, even though the Apprenticeship Agreement has to be signed before or on the Start Date, (but which start date). I think it just gets confusing for people when there are more than one start date to start confusing things. I do wish they would make it just simple so there can be not discussion and it is what it is!

That's what we are doing now. But with Covid etc we were doing more training online and signing up remotely, so not sure where we stand with this.

I have a follow-up question. Would an auditor be happy that you could just produce evidence that you had "sent" or "presented" course material? At a recent mock audit that we commissioned, although we recorded full details on the first leaner progress review (conducted on day 1 on the learning start date), that we supplied the apprentice with course work etc, and this was signed by the employer, learner and employer, the auditor did not accept this as evidence of in learning on day one and said had this been a legitimate formal audit, would deduct funding. What are your thoughts and counter arguments please?

This question has come up time and time again within our company. Please be careful when you use the term "Induction" as evidence of in learning. We have been told by a few auditors that induction does not count as in learning and the Funding Rules state "The date learning begins. This does not include enrolment, induction, diagnostic assessment or prior assessment"

Hi Martin Sorry for jumping in on this one. Where abouts and in the which guide are you referring to where is says "will not fund any part of any learner’s learning aim or programme that duplicates provision they have received from any other source" We have a learner who was with another provider last year and was working towards the same standard. I seem to recall sometime ago that we needed to contact the previous provider to obtain how much funding has already been drawn down? And it came out on one of the funding reports? I remember it saying somewhere that the funding always follows the learner and not the provider or something along those lines. My problem is, that although the PLR says he was studying for said Standard and sub aims, he didn't complete. I am now being challenged and asked, what if his attendance was bad or didn't learn anything, and he hasn't got any certificates etc. Can you please point me to where I can find this information and if possible what reports will tell me he has already drawn down funding for this Apprenticeship. Thank you in advance for any advice.
