Thanks for your reply Martin. I have read the rules several times but what's confusing is P.320.3 that says 'register the apprentice on the apprenticeship service........' - the apprentice would already be registered under the previous employer's account; all we're doing with a COE is transferring the apprentice from one employer to another. I've also raised my query with the AS and they have just replied with this: [image] I have gone back to them though to clarify what they mean by 'at any point.'

Thanks Martin & Ruth for your replies. I should've explained that my query was to do with what date to use in terms of the 30 day gap in employment rule. So Ruth, your advice would be to use the date that their employment contract ended and begin the 30 day countdown from then?

Hi Kelly Yes, they completed the course but failed it. I'm only querying this as the funding rule states that funding can't be claimed for: '80.6. a learner to repeat the same regulated qualification where they have previously achieved it, unless it is for any GCSE where the learner has not achieved grade 4 (C) or higher' It refers to the achievement of a qualification rather than the learning towards it. I guess though that's where the RPL would be taken into account??
