I don't think we've ever had a query about us NOT returning it for learners who were 25+, so it shouldn't be an issue now given it is equally irrelevant to determining eligibility for funding.

Reason Required To establish employer eligibility for apprenticeship funding We've never returned it unless the employer and apprentice combination was eligible to have co-investment waived. Why would it be returned in circumstances where it does precisely nothing to establish employer eligibility for funding? Sorry - I know you've said this, but just repeating it to show how nonsensical it is. I'll try asking them myself: see if I get a different answer.

Thank you, Steve. You can see why I'm second guessing myself though! I have managed to read these rules both ways as you have. I wish they would just give a clear set of examples, but I know that's a pipe dream. I've also asked the helpdesk, so I'll see what they say. As ever, it's important to know what other non-ESFA people think so we can collectively identify where the ESFA think they are being clear, but are not, rather than it just being certain individuals not understanding (like the wishy-washy wording the first time they introduced the 28 day "rule", where we all interpreted it differently to their intention).

I found this discussion while looking for something else, and thought I'd add my recently acquired additional knowledge. Ruth Canham-James stated Looking at we've done in previous years, we did record new TNP values, but we recorded them as Residual prices. I don't know if that's correct, but we got the right funding. That is correct. We recently had someone restart after a withdrawal, and when looking closely at their funding as they were already moving to another employer I noticed that the monthly payments were hundreds of pounds less than they should have been. I contacted the Apprenticeship service helpdesk, and they told us to change the price records to residual ones. If you don't do that, they calculate the OPPs for the restarted episode using both the duration of the withdrawn data and the restart episode, but using the lower price that you've entered. Changing the price to a residual one immediately added £300 per month!

Thanks Ruth. I agree with you. In this case the department chose option 2, as it seems the learning they needed to repeat was so embedded in everything else that it just wasn't possible to have them dip in and out of learning, and this was the simplest way to do it.

Ryan Wiseman (sorry there are 4 profiles with that name, so if this is wrong I can't tell) To some extent you would look at the rules when they started, although I think I'd apply the need for a statement to all finishing early and with less than the full planned hours who started before 25/26 to be safe. 25/26 rules in this area can't apply backwards as there has been a fundamental change in how OTJ is calculated. No, you do not have to give back funding. You just need to have on file a record of the difference between the planned and actual, and the reason why they are different. It's not like a Skills Scan.

Change the 6:3 coding to 3:3. Add the end date to the FAM record, and add the actual OTJ hours done to the programme. You don't have to bring them back to withdraw them, just convert the break to withdrawal. Becky.
