Hi, Just to pick up this conversation again, what if the learner intends to renew? It seems pretty detrimental to the learner not to allow them to enrol if they currently hold a valid visa and plan to renew it. Reading rule 20.4 it seems that, in terms of visa holders, only learners who are in the process of visa renewal can be enrolled because the other visa holders wouldn't have the time left required to complete an apprenticeship thanks Jenny.

Thanks Martin. I see now! If the apprentice has done over 75% of the apprenticeship then they can stay on for an unlimited time (hence at least 12 weeks!). Sorry if i was being silly. Jenny

Hi Steve, Thanks for your reply. I raised this with the service desk and they confirmed the following: Applicants on Graduate Visas are ever eligible? If the graduate visa covers the length of the apprenticeship then they would be eligible (i.e. 12 month apprenticeship) Can learners accrue 3 years at any point before the apprenticeship or is it only immediately prior? P371 states that: A non-UK national is eligible for funding if they have been ordinarily resident in the UK and Islands for at least the previous 3 years on the first day of their apprenticeship and have permission from the UK government to live in the UK (not for educational purposes) or have obtained pre-settled or settled status under EUSS. Therefore, no, the 3 years must be the immediate 3 years before their apprenticeships starts. thanks, Jenny

Thanks, Steve. One more question, if i can be cheeky? The funding rules seem to imply that the 3 years have to have accrued immediately prior to the start of the apprenticeship. But based on your response you don't seem to think this? If a learner is in the country for 3 years, then is on a student visa/graduate visa (where you cant accrue time, as it were) immediately prior to wanting to start a apprenticeship, you would say there are eligible? thanks, Jenny

Hi Steve, Was a response ever received about this? We have a learner who has been in the UK since 2014, they now have a Graduate visa for 2 years which isn't long enough to do an apprenticeship. The learner plans to apply for indefinite leave to remain in 2024 when the graduate visa expires. thanks! jenny

Hi Steve Thanks for your response. We weren't aware that the learner was completing level 3 (and 4 ) in her own time. She bought the books, studied herself and sat the exams with another provider. She started the level 2 with us first, so there's no prior learning and in the middle of it she apparently started level 3 on her own without our knowledge. She has now passed level 3 and onto level 4. I'm just wondering where we stand in regards to the getting the level 2 apprenticeship completed? thanks, jenny
