Steve is correct as when I checked yesterday while it does state NINOs are required for those in receipt of active benefits it also states further down the page on the ILR spec that its only compulsory/mandatory (cant remember which terminology it used) for apps.

Interesting, I didn't think Asylum Seekers were allowed to work, or claim benefits - they normally receive NASS. Are you sure they haven't been granted permanent stay like ILR for example?

I'm fairly certain the ILR specification has always stated that NINOs are mandatory if a learner is in receipt of a benefit or they are an apprentice- not sure about the ILR error side tho. Just out of interest, why do they not have a NINO?

If you are the main provider the learner would be on your ILR at present, are you saying you havent declared the subcontractor but you want to now? You want the learner transfetrd fully to the subcontractor? if so this will count the same as a withdrawal for stats purposes as we did this a while ago but for different reasons. Declaring a subcontractor retrospectively is something that could get you in trouble in a audit as the subcontractor should be declared and on your paperwork from day 1.

I can see what you mean now. We have never enrolled learners at below L1 for FS. I suppose it would work the same as doing L1 then L2. They would have to pass E3 and then L1. Steve Hewitt: are we reading the guidance correctly?

Hi Keli, I believe the aim of this section is to stop providers enrolling on L1 FS where the learner is working at that level already. We have had colleagues get confused with this due to L1 being the requirement for a L2 standard. If they are working below L1 they would need to pass L1 and attempt L2 afterwards.

Thanks both. I have a scheme of work but it doesn't have specific dates. The provider suggested they could give dates for one of the courses covering days 1-3 and the other course covering the remaining days.
