Hi If the total planned hours for the overall programme is 580 hours+ and the learner has a grade 3, they must enrol on the GCSE to meet COF. If your programme is less than 580 hours, I believe this class’s the programme as PT and therefore you can enrol them on the FS if that is the better route.

Thanks all. I was having a silly 5 minute moment and I couldn't understand why the subcontracting rules don't include apprenticeship provision but the criteria for the standard do. I then realised that the subcontracting rules for apps are referenced separately in the apprenticeship subcontracting rules🤦♀️

It’s definitely in the standard contract template. I believe under IAG or something like that. If you search the document for Matrix it should come up.

Do you have a contract with DFE? Their standard contract for services template does stipulate this as mandatory

Settlement normally means indefinite leave to remain. I would still ask them for their evisa share code to confirm they still hold this as their permit expired in December

There was previously a rule where if the learner had not returned prior to the R04 ILR two years after their BIL, they are counted as a withdrawal.

Based on evidence I have seen previously a residency permit with the words settlement have equated to the same as indefinite leave to remain. However, I thought you had to be resident for 5 years to be anwarded indefinite leave but I could be wrong.
