I know Steve and others will probably say yes. My only concern is that the rules state they must also have been resident in Uk/EU on 31Dec2020( the deadline for claimants to apply for EUSS.) I’m not sure a tick box on a form is strong enough evidence to support this. Maybe I’m wrong. It’s not something we would allow but I don’t create our residency policies.

This is so funny as I had a conversation with one of our new AEB subs recently regarding this who were very disappointed that they won’t receive the 20% area uplift due to around 60% of their delivery being in a classroom setting but in zoom. its always been the case (except during covid flexibilities) that the uplift relates to where the majority of delivery takes place and if that’s online you set up location as postcode Zz99 and receive no uplift. Obviously if anyone else knows any different please advise

What status is mentioned on their residency card? I can’t remember the exact wording but there is something in the rules that says if someone has applied for a extension their status is valid but obviously if they can’t apply for an extension the time of enrolling yes that’s a risk to the provider depending on length of residency and status but also their employer too if they are an apprentice.

When you say didn’t achieve do you mean they completed lessons but they weren’t certificatated ? If so I think you’d struggle under RPL as they would have learnt everything.

I believe you’re correct in what you’re saying. Sadly anyone with a practical expected date of around April/May will struggle to complete that year- dependant on length of EPA period. Meaning they will count in the following year if your achievement date is on 1st August or later.

There used to be something called temporary absence (not time specific) but I don’t know if it’s referenced in any of the funding rules or whether it still exsists. My gut instinct is this learner is not eligible due to breaking her ties with the UK. I’m sure if I’m wrong others will tell me.
