Well, here's interesting... There's no such rule in the last version of the Rule Validation spreadsheet (V5 from January), that only goes up to LearnAimRef_113, so looks like they've just applied a rule a little hastily. Good thing it's not the end of the month! Wouldn't worry about it this week, looks like a glitch at their end to me.

I Am Not An Employment Lawyer, but I agree with Dan, Kelly and Patrick here, anyone who is tret as a "normal" member of staff isn't a sub-contractor, regardless of how they're paid.

Two separate answers here! Where they complete early, follow the guidance (and helpful flow chart) P64-P66 in the funding rules (but, basically "yes" as long as they've passed minimum duration) Where they go past their Planned End Date, the OTJ doesn't increase.

So, App funding for E&M IS NOT subject to RPL for prior study, you totally get the whole £724 regardless. (actually, if this was Adult Skills, you can ALSO totally have the whole amount again because they FAILED, as long as they come to the classes) The only time you reduce E&M on Apps is when they come back from a BIL to the same qual that you've already delivered some of.

It's any continuing learners, doesn't matter when they started. In your example above, yes the learner is still on-programme but can now go to Gateway if only thing stopping them was failing Maths (you'll need to sign it all off with the employer though (and hope your EPAO has updated their procedures!!!))
