As long as you have the evidence of contact and work being completed you shouldn't have an issue. I'm assuming the learner started in September or similar and has moved but is able to complete the course. Learner hours won't need to change from what was planned (unless any distinct qualifications will now no longer be deliverable. I would be marking them as as closed off any registers they will not longer require attendance/monitoring on though if your organisation has a mark for distance learning that would also suffice.

We seem to deal in absurdity on the regular, I agree it would be punishingly unfair on the learner. I suppose there is nothing stopping you keeping the new employers records away from the ILR and have them sit outside the EPA process. Would be good to get the official stance on this or hear form someone who has reported an occurrence in this way.

How many days are they out by? Are they aims that have their own contract type (Maths and English) or just regular component aims? If they aren't funded elements you might prefer to make a note on the file explaining the error as it won't have any implications for the overall programme funding or achievement. You can't amend the start dates if they were returned in a previous year ILR, you would need to withdraw them back to start and re-enter them with the correct date.

They don't have to, you get paid the same either way and it still counts as a completion at least. Obviously you would prefer to get the achievements in but at £900 a pop that's a hard sell.

Not sure why you would by closing the programme aim if you have a component hanging anyway as they can't have finished the programme without it assuming it was a mandatory qualification. If it wasn't it potentially shouldn't have been recorded as a component element. "Programme rule: A learner must not have open component aims where the corresponding programme aim has been closed, except where the component aims are English or maths aims. Where the latest programme aim has a Learning actual end date, all component aims (except English and maths) with the same Programme type, Framework code, Apprenticeship pathway and Standard code combination must also have a Learning actual end date."

I think if I wanted to do this I would do some excel wizardy using a top 1/latest prior attainment from our main data source matched against the learner ref/ULN in the submission reports. I assume the reason they wouldn't include it in the submission outputs is that you can record multiple prior attainment levels in the same ILR year so it isn't necessarily straightforward or universally defined.

No worries, definitely worth doing to protect your figures a bit. You have incurred the costs of onboarding, an amount of learning plus all awarding body fees so I think it's very reasonable. Obviously if you have loads of learners coming in and backsliding on grades auditors will be wanting to understand what's going on.

Understandable but I think as the ILR spec says activity necessary to complete it's fine. I've also incorporated the logic used in apprentice functional skills completions and the guidance on recording HE completions when considering this. We've had a number of internal audits over the years and hasn't been raised as an issue.
