I can't say I've seen a rule in the guidance that says the learner can't enter Gateway, but if you think of it logically, the employer gets the completion certificate so where is the incentive to pay you once that has happened?

What success have you had with completing a skill scan using the KSB of the L2 in a tripartite manner, including the employer. Possibly recommend the L3 rather than the L2?

Of course if they have been paying them cash in hand with no contract, that is another issue......... I've got to say I really dislike this manipulation, but I'm sure it does happen.

No they can't claim the incentive as the guidance states they cannot have been employed by the employer during the previous six months. Will be checked through NI number.
