Hi Jessica, It would go back to your contract and schedule with the employer. If its not mentioned than potentially not. We often have learners that complete their mandatory qual first and then refuse to complete the apprenticeship - it hits us hard on achievement rates and the employers often do sod all.

It would be a withdrawal for you and would be connected to their LDIL. It seems odd to give advance warning of withdrawaling, unless through redundancy. Is there a reason why they dont want to continue?

I was sure there was something in the rules that stated that apprentices cant be charged for anything but I'm struggling to find it referenced anywhere in the rules. I'll keep looking for you.

Ruth- I wish we followed your rules we are way more sticter (which causes nothing but agro at times) I agree self declarations are acceptable in the rules.

Apprentices- Yes or check their PLR. For AEB its more important when its linked to a legal entitlement i.e first L2. We dont tend to check if its not legal entitlement, we accept a self declaration For FS I think there might be something in the rules that says learners can repeat FS courses. For other courses you cant be funded more than once for the same learning aim. Re the L3- no as long as its not the same L3 that is linked to their Apprenticeship

I might be wrong here but I think it would be a withdrawal as they won't count as completed until they fully sit the EPA and I'm sure you can't put learners on a Break once they've entered Gateway. Maybe one for the experts i.e. Steve/Martin

Hi Debbie all subs have to be on ROTAP thats clear as mud in the rules. I cant say what approach an auditor would take when this comes to light, they could recover back the funding as could be deemed as a breach of the Subcontracting rules. Do you not have your own auditor you can run this by? Maybe the company that will complete your annual Subcontracting controls audit?
