I'd be asking him about his visa status just to confirm what it is and when it expires? Of course, people can't reapply until their visas are about to expire, so it's not a deal-breaker, but it's useful to know. Otherwise, he sounds fundable but it's good to know those details just in case an auditor asks (and you know I'm not a fan of "just in case" data collection in general!)

Yes, this is covered somewhere in the depths of the 16-19 guidance (of course, I can't find the specific para now!). Not least because the learner will affect the retention factor of the initial provider (in two year's time).

Yes, it's not the learner's fault they're not allowed to extend further, so it's fine. Particularly where it's ILR and the learner has every intention to stay here.

If she's here on a working visa, it'll be P375 that applies, so she'll be fundable after she's been here three years. Given she's on a working visa I'm *assuming* that none of the Family Member rules (P381 onwards) will apply (otherwise she probably wouldn't need the working visa!)...

Ooh, going to get a bit tricky this. Someone on 20 hours a week has a (legal) minimum duration of 78 weeks (18 months, give or take), so they can't complete before that as far as I know.

Yes, because they're different funding streams, it's fine. I suppose the question is does the learner need to attend all of the remaining classes (and therefore have all of the hours) or have they already learnt some of the stuff on their App, that's how you'd do the "funding adjustment" as such, if the learner wasn't planning to attend a bunch of sessions.

Not *quite*! It's not a flat percentage, it's a curve. So the minimum *tends* to be 20 I think (even if that's everyone!), then once you get up to a couple of hundred it goes up to 30, and then if you've got loads and loads it tops out at 50. If you've got PDSAT (and have it linked to FIS) you can click the sampler button and it will tell you what your sample size will be.

Has the certification date passed or just the last date for new starts? If it's just the latter *and they can complete before the certification end date* then the Original Start Date field (and the restart flag) will stop them erroring. If the certification date has gone or they won't complete before it, then they shouldn't be restarted on the same thing.

As long as you keep an eye on where everything is, the latter would always be my preferred option. The evidence pack is meant to be made up of "naturally occurring evidence", after all. Also, it's not like auditors will parachute into your office with no notice at all. At worst you'd have a week (and probably more like two) between getting the sample and them starting, so that's the thing you need to think about, what can you get together in that amount of time?
