An auditor would probably be the best person to sense check for you. Presumably you have one because of the need for the annual audit, now being replaced by the subcontracting standard ?

What about page 15 of the 21/22 ESFA AEB rules (section 40 ?) This relates to family members of EU or UK nationals. Although it says they must have settled status which doesnt apply surely if the spouse is British. I wish they hadn't removed that table they had in previous years funding rules.

Hi Louise, If it helps we asked our internal auditor this question a while back and they advised in addition to us having the contract in place with the EPAO that we should be responsible for processing the gateway paperwork. The process we follow includes: 1) registering the learners with the EPAO. 2) audit checking the OTJ log 3) ensuring that the evidnece is correct 4) uploading gateway evidence and booking and paying for the EPA. I hope this helps.

6 months wowza. Sadly unless the learner is being made redundant this would be a withdrawal as the learner has to be employed until they successfully complete their EPA a bit sad that the EPA told them differently. Is there really no way of the EPA element somehow being condensed so it can be finalised before she leaves her employment? K

We have worked with Distance Learning providers before and we withdrew learners based on online learner activity. My advice would be if you can evidence that some form of learning took place when they accessed their VLE then you can use that date. Auditors will just want to know about the controls you have in place for your VLE software.
