I believe it is legally permissible and as long as you have ongoing logs of contact/learning signed and verified by employer I can't see it being an issue that way. You could also get them to confirm they are so via email. I struggle to imagine any such learner is likely to be a good candidate for a successful apprenticeship though!

Thanks for the reply Steve, so even if the learner wants to pay to do a course that would be highly beneficial for them so they can't? I suppose the logic is that one only needs so much education at a time funded or not and it would encourage providers to offer some courses as paid only creating a wealth based inequality for 16-19 learner?

I've had the experience, I guess the logic is that because the DLOCK shows any learners you won't be paid for they need to appear here as well. The ones I've checked are matching as you say.

Just took a quick look and I knew the policy update isn't listed in the 23/24 rules as far as I can see. So it wouldn't be unreasonable to assume the rule will only kick in for learners who will be reaching gateway after August 1st (though surely this would mean gateway could be put off until then though this may impact learners QAR hybrid end year). If you are looking to implement this straight away it would be worth contacting the ESFA for direct clarification and sharing it here.
