Hi Ruth Thanks for your reply - which confirms exactly what I have done - yet we have not being paid correctly ie we have not received any new monthly payments since restarting and now they have completed we are only being paid the difference between the residual price and what was previously paid under the first period of learning - in essence the restart is being treated as just a renegotiated price...suggesting that the TNP codes for the restart should have been recorded as TNP3/4?! I am currently awaiting a reply from the helpdesk on this one....so wish me luck! Tracey

Hi Ruth We've treated them as a new start from 9/10/25 and assumed that as they were on less than 33 days previously (PLR confirms only this one episode in 2023) that it would not count against us. It does seem very harsh that on one the one hand they are counted as DNS...but the next Provider is the one to lose out!

Hi Steve, I agree that's what appears to have been done - but if a learner is a Did not Start then this should cancel the start surely.......otherwise yet again we are being penalised

Thank for your reply Ruth and I agree it's not clear here...and we are yet again at risk here of being penalised for normal employer practice. It isn't unreasonable for an employer to want new staff to pass probation before they invest either LEVY or co-investment funding into training. If the new employer is willing to sanction BIL, as passing probation is a pre-requisite for resuming the apprenticeship, arguably we could transfer to new employer / then put on a BIL for that reason?

Thanks Ruth They're not on a student visa - its a skilled worker route. They've been her 4 years and the only thing it says she cannot do is access public funds -which seems to be only relating to accessing state benefits
