If the individual has ticked that they are a family member of an EU national, what evidence do we need to see to ensure they are eligible? Do they need 3 years in UK/EU? Do they need settled / pre-settled status? Thanks, Steve

It is a shame they haven't listened to you up to now Steve - as they are armed with all the info, it would make the whole process significantly easier if they supported the new provided with the funding paid and remaining!! Fingers crossed for a change in the future! Thanks for all your help (and yours Ruth)

Thanks both. It might be me missing the obvious, but it seems such a complex situation and, without the necessary information, you're almost in the dark as to what is left and what you should record in your ILR. The above has definitely help so thank you for your help ☺️

Thanks Steve. Yes, we are doing the Skill Scans and other Prior Learning checks to assess where they are. To be absolutely clear I have understood Steve: If the learner is ahead, then we would reduce the TNP1 to recognise this. If the learner is behind, then we would increase the TNP1 and anything above the funding band max is paid by the employer. If they are exactly where they should be, then I use the calculation I state above and record that in the TNP1. Is that correct?

Thanks for your response Steve (I could have issued this query as my first ever Tweet if I had known you would reply :-)) So, to use a specific example, a learner has only been resident in the UK for 2 years (previously in South Africa) but they have a settled status issued from the UK government, are they eligible for an Apprenticeship because the settled status overrides the 3 year requirement??
