Very true - the rules do say if you keep an apprentice on programme under redundancy rules any employer signatures can be signed by the provider. I've actually signed Gateway forms for this reason.

Apprentices are expected to be employed but if the redundancy rules apply and you're allowed to keep them on programme maybe tell them to read the rules.

They can also be fully funded if they are employed, in receipt of UC and earning up to £343pcm (cant remember exact amount) For low wage you'd need to evidence that you've seen their contract of employment or wage slip (within last 3 months)

Just to add im not disagreeing with @martin If they work for the provider but they get work as and when they are unlikely to be a Subcontractor as long as they are under the direction and control of the provider.

Isnt that a question for the Awarding Body? If the EV has seen them then id say they are safe to return but I don't have any experience with EVs so cant comment beyond this.

The Apprenticeship Agreement is needed per apprentice. As the subcontractor I would say it should really be the main provider that completes this type of paperwork. Or at least they shod tell you what paperwork to use.
